These Terms and Conditions ("Terms") govern your use of the InstaPark platform and services ("Service") operated by InstaPark ("we", "our", or "us"). By accessing or using our Service, you agree to be bound by these Terms.

If you disagree with any part of these terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

By creating an account, making a booking, or using our Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

InstaPark is a digital platform that connects vehicle owners with available parking spaces. Our Service includes:

• Online booking of parking spaces
• Payment processing for parking fees
• Space owner listing and management tools
• Customer support and dispute resolution
• Mobile applications and web-based interfaces

We act as an intermediary between parking space owners and users seeking parking. We do not own the parking spaces listed on our platform.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use our Service. We reserve the right to refuse service, terminate accounts, or cancel bookings at our sole discretion.

5.1 Booking Process

• Bookings are subject to availability and confirmation by the space owner
• All bookings are non-transferable
• You must provide accurate vehicle information for your booking
• Bookings may be cancelled subject to our cancellation policy

5.2 Payment Terms

• Payment is required at the time of booking confirmation
• We accept various payment methods including cards and digital wallets
• All prices are displayed in Nigerian Naira (NGN) unless otherwise specified
• Additional fees may apply for extended parking or violations
• Refunds are subject to our refund policy and cancellation terms

5.3 Pricing and Fees

• Parking fees are set by individual space owners
• We may charge service fees for using our platform
• Prices may vary based on location, time, and demand
• All fees are clearly displayed before booking confirmation

6.1 Cancellation by User

• Cancellations made 24 hours or more before the booking start time: Full refund
• Cancellations made less than 24 hours before booking: 50% refund
• Cancellations made after the booking start time: No refund
• Emergency cancellations may be considered on a case-by-case basis

6.2 Cancellation by Space Owner

• If a space owner cancels your booking, you will receive a full refund
• We will attempt to find alternative parking for you
• Space owners may face penalties for frequent cancellations

6.3 Refund Processing

• Refunds will be processed within 5-10 business days
• Refunds will be issued to the original payment method
• Bank processing times may vary and are beyond our control

7.1 General Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any laws
• Provide false or misleading information
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems to access the Service without permission
• Harass, abuse, or harm other users or space owners
• Violate any parking rules or regulations at booked spaces

7.2 Vehicle and Parking Responsibilities

• You are responsible for your vehicle and its contents
• Park only in the designated space for your booking
• Respect the space owner's property and rules
• Remove your vehicle by the end of your booking time
• Report any issues with the parking space immediately

If you list a parking space on our platform, you agree to:

• Provide accurate information about your parking space
• Maintain the space in a safe and accessible condition
• Honor confirmed bookings and provide access as promised
• Respond promptly to customer inquiries and issues
• Comply with all applicable laws and regulations
• Not discriminate against users based on protected characteristics
• Pay applicable fees and commissions to InstaPark

We reserve the right to remove listings that violate these terms or our community guidelines.

9.1 Service Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

9.2 Limitation of Liability

To the maximum extent permitted by law, InstaPark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Our total liability to you for any damages arising from or related to these Terms or the Service shall not exceed the amount you paid us for the Service in the 12 months preceding the claim.

9.3 Third-Party Services

Our Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of these third parties.

The Service and its original content, features, and functionality are owned by InstaPark and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service will cease immediately.

Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with Nigerian law. The arbitration will be conducted in Lagos, Nigeria.

Before initiating arbitration, you agree to first contact us to attempt to resolve the dispute informally. We encourage users to resolve disputes through our customer support team.

These Terms shall be interpreted and governed by the laws of Nigeria, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Lagos, Nigeria.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
